Placing an order
We have selection of cakes ready to be customised and bought online. Please allow at least 48 hours for making and delivering most cakes. For elaborate and multi-tier cakes, please give us at least 5 days when ordering online.
Online orders can be paid via PayPal using all credit cards (you don’t need to have PayPal account to use the service), bank transfer or cash on delivery.
Your order will be processed and email notification of dispatch sent out a day before delivery is due.
All deliveries are carried out between 8-9 am on the date specified on the order. If you would like a later delivery, please inform us after ordering, we will accommodate the most convenient time for you.
There is a mandatory £20 deposit for all order over £50, unless otherwise agreed. Balance is due a day before delivery, if paying by Bank transfer, or cash on delivery.
We deliver nationwide. Please contact us for special rate for delivery over 50 miles from Brentwood, Essex.
Delivery is calculated automatically when you place an order online. You will be given the costs when you start to check out.
Delivery within 10 miles from CM14 postcode is Free of Charge. After that it is £5 for each additional 5 miles. For example: distance to your postcode is 14 miles, you will get charged £5 for delivery, 23 miles, fee will be £15, and so on.
Refunds and Cancellation of an Order
We can only guarantee a full refund of your order if we receive your order cancellation instructions at least 24 hours before the collection/delivery time.
What happens if there is a problem with the goods?
In the unlikely event of there being a problem with any of the cakes we have supplied to you, you may return them to us for a full refund or a replacement within a reasonable period after the date of delivery. Please contact us to discuss the matter prior to returning the cakes. If the cakes have been altered by you or the fault has arisen through something we would not consider to be reasonable then we reserve the right to decline a refund.
Generally, after the cake has been collected from our locations, you are responsible for any damage or accident while transporting the cake in your own means of transport. Cakes must be placed on a level surface (booth of the car or passenger side floor, but never on the seats), free from loose objects, and driven carefully, maximum 50 mph, taking great care on turnings and roundabouts.
What happens to my customer details?
We will not pass on your details to any third parties. However, we would like to send you notification from time to time of our new products and would welcome your agreement to remain on our mailing list. Please inform us if you do not wish your details to remain on our mailing list.

You will be asked to provide personal information when ordering cakes or cake related products online. The lawful basis for processing and controlling the customers data is “Contract” as by ordering any products using the website www.tortecakeart.co.uk puts you as customer and the Company in contract where the Company is the personal data controller and processor that delivers the cake orders to the data subjects (the customer).
The categories of data we process are:
- Personal data for the purposes of direct mail/email/text/other marketing
- Personal data is stored in the EU whether in digital or hard copy format.
- Personal data is obtained when the customer contacts the Company via email/telephone, social media or through the Company’s website to order cake/cake related products.
The lawful basis of processing personal data such as name, address, email or phone number is:
- Consent of the data subject
- Processing is necessary for the performance of a contract with the data subject or to take steps to enter into a contract
The retention periods for personal data is 2 years after it was last processed.

The PayPal pages accessed through www.tortecakeart.co.uk are secure and any personal details obtained about you will be kept only in accordance with the principles of the data protection act 1998. You must bear the risks associated with using the internet when looking at or booking from our website.
Nothing in these terms and conditions shall exclude the liability of Torte Cake Art for personal injury or death caused by its negligence.
By means of your order you are agreeing with these general business terms and conditions.
We reserve the right to amend these terms and conditions from time to time without notice.
These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
